New Hutch arrived damaged

 That's quite a bit of damage, I'd keep trying where you bought it from & email some pictures across to them. Where did you buy it from ?

you didnt get it from the bargain basement did you? as that stuff is slightly damsges sometimes, hence the cheap price

if it wasnt from there, then keep ringing them, as they should either swap or give you a partial refund x

From a few companies websites, this information may help you

The general concensus seems to be:
When signing for a delivery the customer is accepting that the correct number of parcels have arrived and the goods have not been damaged in transit. It is not sufficient to sign the delivery UNCHECKED if parcels are damaged. They should either be refused or signed for as DAMAGED.
If the number of parcels delivered does not match the number on the consignment note, this must be stated SHORT DELIVERY.

With hind sight if the box is damaged the delivery should have been either refused or signed for as damaged even if there is no evidence of damage to its contents.

I hope that this is resolved quickly for you.

Happy hutch again, well our insurance won't cover it as it was signed unchecked

So now we're waiting to hear back from TNT to see whether they'll take it away for us as we don't drive and they told me to sign it unchecked.

17. CLAIMS PROCEDURE

If you wish to claim for a lost, damaged or delayed shipment you must comply with any applicable convention or if none applies you must comply with the following procedure otherwise we reserve the right to reject your claim:

a) you must notify us about the loss, damage or delay within 7 days after delivery of the shipment or within 7 days of the date the shipment should have been delivered. If we send you a claim form you must return it within 21 days from the date of issue fully completed together with all relevant documentation in support of your claim. We are not obliged to act on any claim until our carriage charges have been paid nor are you entitled to deduct the amount of your claim from our carriage charges.

b) we will assume the shipment was delivered in good condition unless the receiver has noted any damage on our delivery record when he or she accepted the shipment.

c) your right to claim damages against us shall be extinguished unless an action is brought in a court of law within 1 year from the date of delivery of the shipment or from the date on which the shipment should have been delivered or from the date on which the carriage stopped.

d) in the case of damage exceeding £250, you must give us the opportunity to examine the damage and the packaging prior to repair.

e) the shipment shall not be deemed to be lost until at least 30 days has elapsed since the date you notified us of the non delivery. We may agree with you in writing to shorten this period.

f) we may destroy the original documentation relating to your shipment after 6 months and you shall not hold this absence against us.

You can see quite clearly why TNT said to write unchecked.

I can't believe he told me to sign it unchecked  things could be so much worse though, at least happy hutch are going to send out a new back piece (really hope it is the back piece that's broke)

I'm not too bothered about having to get rid of the broken piece it's more my OH. We need to hire a skip anyways to get rid of a few things, have a good clear out of broken toys and other bits that we can't sell on or give away. It's just Darren doesn't like to be told no to things, I'm talking about him on Thomas' thread (rabbits in need area) as his attitude is he's always right :lol:

Take it as a learning experience, you wont sign unchecked next time. I had the same problem when I had a new kitchen ...... and most of the doors looked like they were rammed with a fork lift.

Once you have the replacement bit, put the old panel on freecycle. Someone may find a large piece of braind new wood useful, which will save you getting rid of it.

I'd keep the old hutch and see if you can use it for something else one day, or take it apart and use the wood to insulate the new hutch.
